Access Over Council Reserves

Council By-Law 3 - Local Government Land states "no person shall without permission on any local government land" conduct the following activities.

Use local government land in a manner likely to damage its surface, damage, alter, interfere with or remove a building structure or fixture or drive or propel a motor vehicle.

Anyone wishing to place gain access over a Council Reserve is required to complete an Application Form. The applicant shall take out and keep current a public risk insurance policy in the name of the permit holder, insuring the permit holder for a sum being not less than ten million dollars ($10,000,000) and provide Council with evidence of such public risk insurance policy with the application.

To obtain permission the applicant must

  • Complete the application form
  • Provide public liability risk insurance to the value of Ten Million Dollars when making the application.
  • Notify the Council of the date of completion of works.
  • Pay for any reinstatements that Council considers necessary to the surface of that part of the said land or to the section of road reserve, kerbing and watertable used for access to the said land.
  • Pay for any replacement of trees and shrubs, which may become damaged due to, use of the access allowed.
  • Ensure that no existing street trees or plants are removed or pruned (without permission of Council).
  • Comply with any conditions imposed by Council.

An Authorised Officer from Council will inspect the site before permission is given.

A minimum of 3 working days is required to process all applications.
