The City of Tea Tree Gully proposed to make a Road Process Order to close, sell and transfer a portion of Tina Drive between Berryman Drive and Eileen Street (adjoining allotment 12 DP 27649 (Clovercrest Shopping Centre). This proposal is pursuant to Section 10 of the Roads (Opening and Closing) Act 1991.
The owners of Clovercrest Shopping Centre expressed an interest in purchasing a portion of Tina Drive, Modbury North between Berryman Drive and Eileen Street for the purpose of providing additional car parking spaces for the shopping centre, as the Montague Road upgrade in 2009/2010 reduced the number of car parking spaces available. Community engagement regarding the proposed closure was previously conducted in 2009 (see below).
A surveyor was engaged by the shopping centre owners to conduct further consultation with affected property owners as part of the requirements of the Roads (Opening and Closing) Act to determine their current views.
In June and July 2009 Council engaged with the community on this proposal as part of the Montague Road Upgrade Project.
Residents and businesses along and in the vicinity of Montague Road (where the upgrade works were to take place) and in the vicinity of Tina Drive, Modbury North were targeted for this consultation.
A total of 94 letters were sent to identified stakeholders (businesses, residents and/or property owners) explaining the purpose of the consultation and 30 responses were received in relation to the Tina Drive matter. Responses indicated that nineteen (19) respondents were in favour of the road closure, seven (7) opposed, and three (3) had no opinion on the matter. One respondent did not indicate either way however did indicate that they had no issue with Tina Drive becoming a car park.

Submissions closed Friday, 5 August 2011. Any application for easement or objections were to be made in writing to Council and the Surveyor-General.
Where a submission was made, Council will provide notification of a meeting dealing with this matter.
