The City of Tea Tree Gully (referred to in these Terms as Council, we, us, our) enables customers to create a User Account to raise or report requests for service and/or to be eligible to access rates information, receive rates notices and receive other communications from us electronically by using the myTeaTreeGully portal https://my.teatreegully.sa.gov.au

This is a binding agreement between Council and any person (you) who registers a User Account on myTeaTreeGully. These Terms apply in addition to, and incorporate, the terms and conditions of use of the City of Tea Tree Gully website

To access and/or use your User Account on myTeaTreeGully, you agree to be bound by and comply with these Terms.

1.  Requirements to access myTeaTreeGully

a)  To access rates information or receive rates notices through myTeaTreeGully, you must register a User Account. You do not need to register a User Account to use myTeaTreeGully portal to raise requests for service.

b)  To be eligible to register and use myTeaTreeGully to access rates information, you must:

i)  be the owner of a property within the City of Tea Tree Gully area (the Property);  or

ii)  a person duly authorised by the owner of the Property to receive rates notices in respect of the Property.

c)  Only persons who are eligible to register, as set out above, are permitted via myTeaTreeGully to:

i)  link the Property to their User Account; and

ii)  view or manage rates notices in respect of the Property.

d)  To create a User Account, provide us with accurate, complete and up-to-date information as requested on the registration page. It is your responsibility to inform us of any changes to that information.

e)  You must provide a valid email address for the electronic delivery of rates notices and other communication from the City of Tea Tree Gully. You must keep your nominated email address current and active to continue to be registered for the myTeaTreeGully portal.

f)  You can change your nominated email address or any other relevant details at any time through your User Account.

2.  Responsibility and security

You acknowledge and agree that:

a)  each User Account will come with a username and password

b)  you must keep your username and password confidential and not disclose it to any other person

c)  you are solely responsible for all activities that occur on your myTeaTreeGully account

d)  you must change your password regularly and notify us if you have reason to believe the confidentiality of your password is compromised.

3.  Electronic notices

When you request to receive notices electronically via myTeaTreeGully you acknowledge and agree:

a)  that we will rely on information provided by you for the purpose of issuing electronic rates notices and any other notifications related to your rates information

b)  if you choose to receive rates notices via myTeaTreeGully, a paper copy of rates notices will no longer be issued in respect of the Property

c)  it may take up to one rates notice cycle for your myTeaTreeGully registration to take effect and for you to receive all notices electronically

d)  we will not charge you a fee for accessing a copy of your rates notice via  myTeaTreeGully

e)  the rates notice in respect of the Property will be deemed to have been received  by you once it has been sent via your nominated email address

f)  if you cease to own the Property then you will not have access to any property details or rates notices once the change of ownership is updated, other than notices and information that are related to you as the previous owner

g)  if you cease to be authorised by the Property owner to receive notices, you will not be entitled to (and will immediately cease to use) using myTeaTreeGully

h)  not all communications from City of Tea Tree Gully will be electronically sent through myTeaTreeGully and you may receive communications by post or other forms of communication

i)  you may continue to receive account and/or notices through myTeaTreeGully for up to 30 days after you have unsubscribed while we process your request.

If you no longer wish to receive rates notices electronically via myTeaTreeGully, you can 'unlink' the Property from your User Account. Once this occurs, a paper copy of rates notices will be issued to you for the following cycle.

4.  Privacy

a)  We will take reasonable steps to protect the security of personal information held in myTeaTreeGully from misuse, interference, loss or unauthorised use, modification or disclosure.

b)  You are responsible for ensuring that all personal information recorded in respect to your User Account is accurate, up-to-date and complete. We will handle your personal information in accordance with our Privacy Policy which forms part of these Terms of Use.

5.  Warranties

In registering for myTeaTreeGully you warrant that:

a)  you satisfy the registration and use requirements set out in 1 (above) and you will cease using myTeaTreeGully if you no longer satisfy those requirements

b)  the information provided by you during registration for myTeaTreeGully is accurate, complete and not misleading

c)  you will review and update any information that relates to you or the Property, as required for the receiving of rates notices promptly and ensure that they remain accurate, complete and up-to-date

d)  you will follow any instructions provided by us for the use of myTeaTreeGully.

6.  Copyright and linking websites

myTeaTreeGully, including all intellectual property rights therein, belongs in all respects to the City of Tea Tree Gully. You must not engage in any activity that infringes our intellectual property rights.

Any links to third party websites or software on this site are provided solely as a convenience to you and such links should not be taken to imply any type of association, sponsorship, endorsement, monitoring, approval of, or responsibility for, the linked site or its content. These sites may be located in jurisdictions outside Australia and be subject to license or other types of agreements, policy and legislation relating to those sites.

7.  Termination

We may remove, terminate or suspend your access to myTeaTreeGully if:

a)  you fail to comply with these Terms

b)  your registration details (including personal information) are inaccurate, incomplete or falsified, or you submit any content or information that is misleading or deceptive or otherwise unlawful

c)  you use myTeaTreeGully in a fraudulent or illegal way; or

d)  we suspect that use of your myTeaTreeGully has compromised the security or functionality of myTeaTreeGully or the City of Tea Tree Gully website (e.g. by directly or indirectly introducing a virus or malicious code).

After successive failed delivery attempts to your registered email address, we will contact you to advise you that the notifications could not be delivered and seek an alternative email address. If we do not hear from you we will suspend your account and revert to issuing paper copies of your rates notice.

You can terminate your registration for myTeaTreeGully at any time by:

a)  informing us of your decision, so that we can cancel your myTeaTreeGully account on your behalf.

8.  Liability

a)  Your use of the myTeaTreeGully is at your own risk. We do not give any representations or warranties that access to or use of myTeaTreeGully will be continuous, uninterrupted, reliable, secure or free from viruses or defects, or that its content is up-to-date, correct or complete.

b)  There are a number of factors that could affect the availability of myTeaTreeGully or the accuracy of the information it contains, including telecommunications outages, programming errors, routine maintenance, negligent or malicious acts, or events beyond our control.

c)  You agree to release and indemnify us against all loss, damage, claims and liabilities which may arise directly or indirectly out of or in connection with your use of or access to myTeaTreeGully.

d)  To the extent permitted by law, we exclude liability for all direct, indirect or consequential liabilities, losses, damages, costs and expenses, however arising (including negligence) or otherwise suffered or incurred by any person in connection with or in any way relating to use of or access to myTeaTreeGully.

9.  Variation

a)  We may vary, terminate or suspend myTeaTreeGully and/or the provision of electronic rates notices, at any time and for any reason, without liability to you.

b)  We reserve the right to vary these Terms at any time by uploading the revised terms on the myTeaTreeGully. Your continued use of myTeaTreeGully after an amendment will mean that you agree to that amendment. You must stop using myTeaTreeGully if you do not agree to an amendment.

c)  We will give you prior notice of such changes, if they are likely to have a material detrimental impact on you. Such notice will either be given to your directly (via the contact details you have provided) or by notice displayed on myTeaTreeGully.

10. General

a)  These Terms are governed by and interpreted in accordance with the laws of South Australia and by using myTeaTreeGully, you agree to submit to the jurisdiction of the courts of South Australia.

b)  You may not assign your rights under these Terms, or attempt or purport to do so, without our prior written consent.

c)  Neither party will be liable to the other for any failure or delay to perform obligations caused by circumstances outside of its reasonable control (including illness of our consultants).

d)  If any provision, or part of a provision, of these Terms of Service is found to be illegal or unenforceable it will be severed from the agreement, and the remainder of these Terms of Service will be construed as if that provision or part did not form part of these Terms of Service. The previous sentence will not apply if the provision or part to be severed constitutes a material and fundamental element of the agreement between the parties.

e)  These Terms of Service are the entire agreement between the parties on its subject matter and supersede any previous arrangements, agreements, representations, understandings or statements (whether verbally, in writing or in another format).
